Accident: downed cyclist
Article 286 of the Criminal Code of Ukraine
Problem:
We were approached by a driver who knocked down a cyclist on the Kiev-Obukhov highway. The cyclist received moderate bodily injuries, criminal proceedings were opened according to part 1 of Art. 286 of the Criminal Code of Ukraine . At the time of joining the process, a number of examinations had already been carried out in the case, testifying to the fault of the driver. During the analysis of the case materials, a number of shortcomings were revealed. when conducting examinations. At the request of the defense, repeated examinations were appointed, and also revealed and questioned two witnesses.
Result:
The criminal case was closed at the stage of pre-trial investigation.
Deprivation of driving license
Article 130 of the Code of Administrative Offenses of Ukraine
Problem:
Our client was suspected in alcohol driving. After rewiewing of case materials, video recording from police officer body camera, we find out a number of procedural violations in the actions of police officers. The lawyer drew up written explanations and represented the client during the court session.
Result:
The case was closed and the driver's license was returned to the driver.
Compensation for damage in case of an accident
Problem:
We were approached by a driver who suffered material and moral damage as a result of an accident. The culprit refused to voluntarily compensate for the damage. We carried out an assessment of the material damage, after which a claim was filed in court.
Result:
By a court decision, it was decided to recover material and moral damage from the culprit, as well as the amount of the client's expenses for legal assistance.
